Privacy policy

1. Who we are
Cat Harness Australia Pty Ltd trading as UppaPets Australia, ABN 45 675 062 905 (Uppapets Australia, we, us or our), operates uppapets.com.au. This policy explains how we collect, hold, use and disclose personal information when you browse, shop, contact us or use our related services.
Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable. We aim to handle it openly and responsibly, consistently with the Australian Privacy Principles. Nothing in this policy limits rights or obligations under applicable privacy law. This policy explains our practices; it is not a request for blanket consent to every use of your information.
2. Information we collect
The information we collect depends on your interactions with us. It may include:
- Contact and delivery details: your name, email address, telephone number, billing and delivery addresses, and delivery instructions.
- Orders and account information: products purchased, order history, returns, warranty claims, account details, preferences, payment method, transaction references and payment status. Payment providers process the payment details you enter at checkout under their own privacy and security arrangements.
- Enquiries and content you provide: emails, chat messages, feedback, reviews, photographs and information supplied when seeking product advice or support. This can include pet details and product preferences, such as answers to our stroller quiz, where linked to you.
- Website and marketing activity: IP address, approximate location derived from it, device and browser information, cookie or advertising identifiers, pages and products viewed, cart and purchase events, referring links, and interactions with our emails and advertisements.
- Privacy and marketing preferences: subscription choices, consent records, unsubscribe requests and records needed to respond to privacy enquiries.
We do not need sensitive personal information, such as health information, to sell our products. Please avoid including unnecessary personal information in messages, reviews or photographs, and do not send payment card details or identity documents by ordinary email.
3. How we collect information
We collect information directly when you order, create or use an account, subscribe, complete a form or quiz, submit a review or contact us. We also collect information through cookies, pixels and similar technologies, and receive information from Shopify and the payment, delivery, support, analytics and advertising providers involved in your interaction with us.
You can browse without telling us your name, although technical information may still be collected. Where practical, you can make a general enquiry anonymously or using a pseudonym. If you do not provide the information reasonably needed for an order, delivery, return or enquiry, we may be unable to complete it. If you provide another person's details, such as a gift recipient's delivery details, please ensure you have authority to do so and let them know about this policy.
4. Why we use information
We use personal information to:
- process payments and orders, deliver products, manage accounts, and handle cancellations, returns, refunds and warranty or consumer-law claims;
- answer enquiries, provide product guidance, request feedback and communicate order updates or product-safety information;
- operate, maintain and improve our website, understand demand and shopping activity, and personalise product suggestions and the shopping experience;
- send permitted marketing and measure or personalise advertising, subject to your choices and applicable law;
- protect accounts and transactions, detect fraud and misuse, and maintain security; and
- keep necessary business records, comply with legal obligations and resolve disputes.
We will only use information for another purpose where you consent or applicable law permits or requires it.
5. Who receives information
We disclose information as needed for the purposes above. Our providers include:
- Shopify for our ecommerce platform, checkout and related services, as explained below;
- payment providers supporting the payment method you select, and our fulfilment, delivery and returns service providers;
- Klaviyo for email and, where used, SMS marketing and customer communications;
- Richpanel for customer support and Judge.me for product reviews;
- Triple Whale for marketing analytics and attribution, and Google and Meta for advertising, measurement and related integrations; and
- technology, hosting and professional advisers who support our operations.
Information shared depends on the service. For example, a carrier needs delivery details, a support provider may need order and enquiry details, and analytics or advertising providers may receive identifiers and browsing or purchase events. Some providers process information on our behalf; others also have their own responsibilities and uses described in their privacy notices.
We do not share Uppapets customer details with our overseas manufacturer, and we do not use those details for Cat Harness Australia or Barely There Litter marketing.
We may also disclose information where you direct us to, where required or authorised by law, to address fraud or protect legal rights, or as reasonably necessary for a proposed business sale or restructuring, subject to appropriate confidentiality protections and applicable law.
Reviews and other content you submit for publication, including your display name and any photographs, may be publicly visible. Please avoid including information you want kept private. External websites and social platforms have their own privacy practices.
6. Shopify and enhanced services
Our store is hosted by Shopify. Information you submit and information about your use of the store is shared with Shopify and relevant third parties, including providers overseas, to operate and improve the services.
We have enabled Shopify Network Intelligence. This allows Shopify to use information about your interactions with our store together with information from other merchants and Shopify to provide enhanced services, including personalisation, advertising, analytics and fraud prevention. For this processing, Shopify has its own privacy responsibilities, including responding to requests concerning its use of your information.
See the Shopify Consumer Privacy Policy for details and the Shopify Privacy Portal for available choices and rights. You can also contact us about information we handle.
7. Cookies, analytics and advertising choices
Our store and connected services use cookies, pixels and similar technologies to operate the website, remember preferences, understand visits and purchases, measure advertising and show relevant advertisements. Information can also be shared through server connections, rather than only through your browser. Advertising integrations may use contact identifiers, including hashed email addresses, to match activity to an account or audience. Hashing does not necessarily make information anonymous.
You can manage cookies through your browser and use any consent or privacy controls displayed on our website. Blocking cookies may affect store features and may not stop information sent through server connections. You can also manage personalised advertising through the controls described in Google's Privacy Policy and Meta's Privacy Policy, and use Shopify's Privacy Portal linked above.
To ask us to stop using or disclosing your information for direct marketing, including targeted advertising, email hello@uppapets.com.au. We will action your request without charge and explain any information needed to identify the relevant account or activity. Stopping personalised advertising does not necessarily stop all advertisements. Email and SMS subscriptions have separate unsubscribe controls.
8. Email and SMS marketing
We send promotional emails or SMS only with consent as required by law. Purchasing from us or accepting our Terms of Service does not, by itself, give blanket marketing consent. Our marketing messages identify us and provide an unsubscribe option.
You can unsubscribe using the link or instructions in a message, or by emailing us. We will action email or SMS unsubscribe requests within 5 working days, without charge or requiring you to log in or provide additional personal information to unsubscribe. We may retain a suppression record to respect your choice. Essential messages about an order, support request, product safety or legal obligation may still be sent.
9. Overseas storage and disclosure
Some providers store or process information outside Australia. Our Shopify store's configured data hosting location is the United States. Shopify and other providers may also use staff, affiliates and subcontractors in other countries.
Published provider locations include the United States, Canada and Singapore for Shopify-related processing; the United States and India for Richpanel; the United States and Israel for Triple Whale; and the United States, Canada, the United Kingdom, Ireland, France, Germany and Singapore across Klaviyo's hosting or support arrangements. Judge.me uses overseas providers, including providers in the United States. These locations describe provider arrangements; the locations used for a particular customer depend on the service and features involved.
Advertising and technology providers may operate in additional countries. Current details are available in Shopify's subprocessor information, Klaviyo's subprocessor list, Richpanel's Privacy Policy, Judge.me's subprocessor list, Triple Whale's subprocessor list and the Google and Meta notices linked above. Contact us if you need help identifying likely locations relevant to your information. For international deliveries, delivery providers and authorities in the destination country, including New Zealand, may also receive information needed to deliver your order.
Where Australian privacy law requires it, we take reasonable steps to ensure overseas recipients handle personal information consistently with the Australian Privacy Principles. Using our store does not waive your Australian privacy rights or our applicable obligations for overseas disclosures.
10. Security and retention
We hold information mainly in electronic systems operated by us and our service providers. We take reasonable steps appropriate to the information and risks to protect it from misuse, interference, loss and unauthorised access, modification or disclosure. No online service can guarantee complete security. If a data breach occurs, we will assess and respond to it and notify affected people and regulators where required by law.
We keep information only for as long as reasonably needed for the purposes described in this policy, including fulfilling orders and warranties, meeting record-keeping requirements and dealing with disputes. Retention depends on the type of record and applicable legal requirements. When information is no longer needed and the law does not require retention, we take reasonable steps to destroy it or de-identify it. Limited records may be retained to honour an unsubscribe or other privacy request.
11. Access, correction and other requests
Email hello@uppapets.com.au to request access to personal information we hold about you, ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading, or ask about deletion or a restriction on use. We may take reasonable steps to verify your identity or an authorised representative's authority, using only information reasonably necessary for that purpose.
We aim to respond within 30 days and will let you know if more time is needed. There is no charge to make a request or to correct information. If a reasonable access charge is permitted and necessary, we will explain it before proceeding. Some information may need to be retained for legal or legitimate record-keeping purposes. If we cannot fulfil a request, we will explain the reason and available complaint options, unless the law prevents us from doing so.
Additional rights, such as data portability, objection or deletion rights, may apply under the privacy laws relevant to you. Contact us to exercise an applicable right. We will not penalise you for making a privacy request. Requests about Shopify's independent processing can also be made through its Privacy Portal.
12. Privacy complaints
If you are concerned about how we have handled personal information or a privacy request, contact us with the details and the outcome you are seeking. We will acknowledge the complaint, investigate and aim to provide a written response within 30 days. If we need longer, we will explain why and provide an expected response time.
If you are dissatisfied with our response, or have not received a response after 30 days, you can contact the Office of the Australian Information Commissioner (OAIC), which can explain whether it can consider your complaint. You may also have a right to contact the privacy regulator where you live. This process does not limit any other remedy available to you.
13. Children and policy updates
Our store is intended for people with legal capacity to make purchases. We do not direct marketing to children. If you believe a child has provided personal information without appropriate authority, please contact us so we can investigate and take appropriate action.
We may update this policy when our practices, services or legal requirements change. The current version and revision date will appear on this page. We will provide additional notice or seek consent where required by law; publishing a revised policy does not itself obtain consent for a new use that requires it.
